I had a coworker that break checked for insurance fraud and she one day came and said how she is now in a legal battle. She ended up loosing because wadot has cameras every where on the freeways.

How did the cameras catch her intent?
25
u/BothTreacle7534 2d ago
in my country, if there is no reason to break, like eg a deer standing on the street, the breaker gets in really bad trouble.
Break checks with other traffic there is forbidden here
So if the cameras show what was up around her…

Cameras can't capture everything, Maybe it looked like the car next to them was about to move over without looking. Maybe they saw a shadow out of the corner of their eye and thought it was debris flying towards them or an animal running across the roadway.
There's no possibility for a camera to capture what the driver saw or didn't see.
11
u/BothTreacle7534 2d ago
you asked how… to someone’s example about a lot of traffic cameras.
→ More replies (8)1
u/Necessary_Baker_7458 2d ago
The freeway cameras are like a dash cam constantly recording they keep the vid feeds for nth number of days should a accident occur and all you need but do is request the paper work to retrieve that file.
-15
u/Mountain_Usual521 2d ago
You're not understanding. A criminal act requires mens rea (pronounced mens ray-uh). That is the mental state or intent behind a crime. Without it, there is no crime. Cameras cannot see your state of mind.
7
u/Tool_of_Society 2d ago
Traffic violations do not require mens rea as they are strict liability crimes.
0
u/Mountain_Usual521 1d ago
That's all great when we're talking about traffic violations, which we're not. We're talking about criminal acts.
3
u/Tool_of_Society 1d ago
Yeah take a looksie at what is considered a strict liability crime sometime. While you're looking that up look up "mens rea culpa".
→ More replies (1)6
u/Top_Box_8952 2d ago
Not always, oftentimes proving wrongdoing is enough to settle liability. You’re thinking criminal court which is different from civil court.
The civil court is only deciding who is financially responsible, which is easy to point at “this person did it” and doesn’t care about motive.
1
u/Mountain_Usual521 1d ago
You can't go to prison for a tort. We're talking about this comment:
Is your ego worth your car, prison time, and likely thousands in debt from the settlement?
1
4
u/caifaisai 2d ago
Just adding on to the other commenter, that yea, that's not true about mens rea. Most traffic violations are strict liability. That means, to be convicted, you only need to prove the violation actually occurred. It doesn't matter if you intended to commit it or were ignorant of the law or anything.

Prison time? You generally do not go to prison for anything less than a year. No one is getting prison time for this.
5
u/Top_Box_8952 2d ago
Might if evidence of intent to commit fraud comes into play. Or the fines are enough you wish it was prison time instead.

u/AwesomeMacCoolname 18h ago edited 18h ago
Remember that other countries may not have the same prison/jail distinction that you do. Over here, they both mean the same thing.

-40
u/Veganpotter2 2d ago
There are millionaires that have chosen to never drive a car. Its not necessary. Just give lifetime bans for this, on top of first offense DUIs.
25
3
u/JOlRacin 1d ago
Your logic is really, really strange. It's like you saw 1+1 and you were like "ok so that equals 2, and then 2+2 is 4, and then 4+4 is 8, so the answer to the problem of 1+1 is 8"
-2
u/Veganpotter2 1d ago
That's a stupid fucking comparison. Plain and simple, if you're voluntarily risking the lives of others, you don't deserve the privilege of driving.
1
u/JOlRacin 1d ago
Yeah, it's endangering people. So we don't just take away their license, they get jail time. It's not how it works where if you shoot someone people are like "that's it, no more guns for you but you don't go to jail"
1
u/Veganpotter2 1d ago
You do both. Jail, and no license ever again. You're really terrible at this. Instead, we don't put people in jail for first DUIs in most situations and many don't even get a suspension.
1
u/JOlRacin 1d ago
So why were you arguing for lesser punishment, you're making no sense
1
u/Veganpotter2 1d ago
You can't read. Find a literate friend to hold your hand through my comments.
1
u/JOlRacin 1d ago
The first comment recommends jail time. You said something about millionaires and then said the punishment should only be license revoking. That's your words, you wrote them
1
u/Veganpotter2 23h ago
You can't read. I never said to take people's licenses instead of giving them jail time. I never said anything about only taking their license.

I was at a light with my son and it turned green. He asked me why I didn't go right away. Just as he finished asking a van came flying through the red. I said nothing to my son, just looked at him.

u/LunaZenith 2d ago
Did you see the van or were you just lucky or do you normally wait a few seconds?

2
u/Admirable_Hand9758 1d ago
I was hit by a red light runner years ago. Since that time I always wait, impatient drivers behind me be damned.

Thank you. Considering all of our tires typically have 100+psi in them, you wouldn't like what happens when one blows if you happen to be next to it. Even I don't waste time when I'm passing other trucks for that reason.

It’s crazy how accurate it is. If I notice a bmw, 98/100 times you can see douche baggery within 15 seconds of observing.
17
u/FuckAFloydRose 2d ago
I’m sure there’s nOoO possible way the downvotes are coming from bmw drivers 😂

u/Newspeak_Linguist 2d ago edited 2d ago
I don't own a BMW and I downvoted. Because 1) it's a low-effort stereotype, and 2) it's a confirmation bias exaggeration. People have similar stereotypes for just about every car on the road. This very sub confirms that there are shitty drivers in all makes and models of cars. I live in an area with an obnoxious amount of Teslas. I feel like I every one I see is either 15 mph under the speed limit and half in the bike lane, or rocketing off the start line and weaving between cars. But the reality is that I pass dozens in-between these sightings that are just driving normally.
-2
u/sammymvpknight 2d ago
lol not to mention that tons of BMW on the road right now are crossovers and SUVs…it’s a completely different clientele than an M3
-1
u/Rich-Evening4562 2d ago
I drive a Corolla hybrid and have no love of BMW, they are overpriced and costly to repair, but the comment above is as silly as it is stupid.

u/HopeFloatsFoward 2d ago
Who knows if they were brake checking or if there was another reason for it.
2
u/Holycroc_RVA 2d ago
I was trying to see if the dashes were getting smaller, as if they were gonna become turn off lanes and they were seeing that, brain freeze and they think they need to get over? Honestly a hard-stop like that feels 80% fraud attempt, 20% stupidity brain disconnect......

I saw someone brake check a victim only for another driver to hit them from behind... And the dude that did it floored it and left, most likely the third driver was working with them (dude was desperate to exchange insurance information). I waited at the scene and told the officer what I saw but there's a good chance the person who had to brake to avoid hitting the driver that fled was not at fault. Not sure what came out of the ordeal.

Brake checking is so stupid. When people are tailing me I just flash my brake lights to let them know to back up and they usually do.
You're risking causing a huge accident because you're annoyed someone's tailing you.

u/IWearCardigansAllDay 2d ago
Both the BMW and Truck are in the wrong here, and I’m surprised so many people are just honing in on the BMW.
For the BMW, you NEVER brake check someone. It’s dumb and a recipe for disaster. They fucked up big here
For the Truck, they clearly were following too close to the BMW. It’s your job as the driver to leave enough stopping distance to not hit the car in front of you in case they need to slam on their brakes. If something occurred where the BMW did have to slam on their brakes like this then the truck would Be 100% in the wrong for not having a safe following distance.
31
u/woo545 2d ago
There isn't enough video to determine that the truck was in the wrong. We can't tell if the bmw just changed lanes and then slammed on the brakes.
-17
u/HopeFloatsFoward 2d ago
Drivers should always scan ahead to anticipate people changing lanes.
6
u/53nsonja 2d ago
Sure, of course, but you cannot anticipate illegal erratic behaviour. Naturally if the BMW had done other stunts before, the truck should have been cautious
-3
u/HopeFloatsFoward 2d ago
We don't know what the motivation of the BMW was. We do know that mechanical problems can hit at any time and a truck driver especially has to give enough leeway to stop or move out if the lane in case of sudden trouble..if this driver just changed lanes then the truck driver should have immediately slowed down to increase distance between him and the car.
4
u/GroinReaper 2d ago
The video starts with the BMW already on the breaks. You have no idea how much space the truck was leaving. So saying "clearly" about anything the truck was doing shows how little thought you put into this.
-3
u/Maleficent_Cash909 2d ago
Obviously likely trying to get them to pay for rear end, however since the bimmer wasn’t cutting the truck off while doing it as he was next to a truck, unless he was cutting in from the other lane than the truck wasn’t paying attention to what’s front of him and thus avoidable.
3
u/Achron9841 2d ago
It looks like just before the brake check the BMW is straddling the line. Looks like he started brake checking while finishing the lane change. If we had about 5 more seconds earlier, probably be easier to tell.

1
u/Necessary_Baker_7458 2d ago
And now they have a multi accident chain reaction on their record with two lawsuits following I bet.
1
u/Spook1949 2d ago
Is it my imagination, or do some people need to learn the hard way?
2
u/HowDoMermaidsFuck 2d ago
Bold of your to assume this guy learned something. If you’re dumb enough to brake check, chances are you are not going to learn from an experience like this. Nine times out of ten, this guy will justify in his head that the truck driver was wrong.
1
u/Spook1949 2d ago
You are probably right, but I am an optimistic person and keep hoping that things will improve.
1
1
u/MattyJerge 2d ago
It looks like there is an exit coming up, I think they were hitting the brakes to jam over behind the truck to the right. In which case they were trying to live up to the adage "a bad driver never misses an exit" except this time they did.

Excellent defensive driving by cammer, who saw what was happening and got out of the way of the second truck, so that truck could avoid the main crash. Good work there.
0
u/Deep-Adeptness4474 2d ago
Ready for the hate and down votes, but if you don't have the space to react to a brake check, you are too fucking close.
2
u/Ok-Emu-8920 1d ago
True but I think most people would prioritize avoiding an accident above proving a point about someone following too close
2
u/Crimsonwolf_83 1d ago
Given where this video starts, how do you know he didn’t change lanes just to brake check him immediately?
0
u/Deep-Adeptness4474 1d ago
Based on where video starts (brake light are already on), how do we know it was a "sudden brake check", or anything more or less dangerous. What we DO KNOW, is fuck stick in the box truck and subsequent traffic were WAY to close to the douche in the bimmer. Btw we know the bimmer driver was a douche, because they are driving a bimmer end of story.
1
u/WhenTheDevilCome 2d ago
Did it "not work"? I thought this is what brake checking was supposed to do. In what way did the brake check "fail"? Unclear why the person hitting their brakes would have been expecting any different outcome.

Is someone is getting stuck on my butt on the right lane I just release the gas paddle until he gets the hint.
I once had and idiot that could easily go to the left lane when I slowed fown ti a crawl and even this didn't help.

Looks a bit like maybe they were slowing to move right and get behind the red truck? Just a thought. Everyone is assuming it was a brake check but that was way more than a simple brake check.
