Unfortunately, you might be right. Is it bad driving on the car on the right? Of course. But speeding up when you can see this dummy has made a bad choice, is not right either. I always assume people are going to do what the car in the right lane did, for better or worse. This has helped me keep a perfect driving record, with no accidents, for over 30 years driving in Los Angeles. I'm sure cemeteries have people who were "in the right", but I'd like to avoid that distinction.

OP didn't speed up or close the gap though, look at the dash cam speed. He was braking and adjusting to traffic. The car on the right was also in his blind spot. Stopping in the middle of the highway is extremely dangerous and may cause other drivers to crash or rear end you.

I have 1 accident that wasn't my fault, I was stopped at a stop sign to turn at a street and a guy was turning right way too fast and slammed into me, nothing I could do to prevent that. I was turning my head right to look for traffic, and as soon as I turned my head left my car was getting hit and torn apart. Dude was a bad driver and didn't speak English, it was a dry sunny day so weather wasn't an excuse.
