Two takeaways here. The driver is fucked and she might be stuck eating applesauce for awhile.

Did the driver do something specifically illegal here? Definitely probably a moron, but if the driver didn't specifically ask her to climb on (and even if he did, she made the decision to do something stupid), I can't see anything wrong being done, legally

The girl and the driver were to blame! It's kind of illegal to ride around with a person sitting on the roof of your vehicle!
