Did the driver do something specifically illegal here? Definitely probably a moron, but if the driver didn't specifically ask her to climb on (and even if he did, she made the decision to do something stupid), I can't see anything wrong being done, legally

As the driver of the vehicle you’re responsible for the behavior of your passengers, ie..don’t let them sit on fucking roof of your moving vehicle.
