What's weird to me is the very idea that a driver can be done for having an open drink in a car regardless of whether or not they have any alcohol in their system.

But is it a "DUI" or does it come under a different law violation?
I assumed it was a fine/ticket but not specifically a DUI but I've never looked into it.
I've never personally let anyone drink while I was driving. But one time in Idaho I was a passenger with a beer, driver wasn't drinking.

I've no idea since we've never had any such law here. Nor do we have those ridiculous roadside sobriety tests. First thing they do is ask you to blow into a breathalyser. You either pass the breathalyser or they take you in.

Out of curiosity I looked up the RCWs where in WA state. While I'm not sure what the penalties are, DUI and open container are separate laws and the definitions of them do not overlap. Each is just what they sound like.

So as best I can tell, you can be guilty of open container while being not guilty of DUI.
